What Should Be in an Admission Agreement at an Ohio Assisted Living Community?
An admission (or residency) agreement is the legal contract that governs a resident's stay, and it deserves the same scrutiny as any other significant contract before signing. At minimum, it should clearly spell out: the base monthly rate and exactly what services and supervision it includes; how and when additional service levels (and their added cost) get triggered as a resident's needs increase; the facility's specific discharge and transfer criteria and notice period; refund and deposit policies if a resident leaves or passes away; the process for rate increases and how much notice residents get; and, if applicable to your situation, the terms of a tri-party agreement layering in a family guarantor — see our tri-party agreement explainer for that specific arrangement. Ohio's resident-rights protections under Chapter 3721 apply regardless of what a contract says, so an agreement that appears to waive a resident's right to appeal a discharge, for example, is worth flagging to an elder law attorney before signing rather than assumed enforceable.
