What Rights Does a Resident Have in an Ohio Assisted Living Community?

Ohio Revised Code Chapter 3721 sets out a residents' rights framework that every licensed residential care facility (assisted living) in the state must follow, covering things like the right to be treated with dignity and respect, the right to privacy in personal and medical affairs, the right to manage one's own finances (or have them managed transparently on the resident's behalf), the right to communicate freely with visitors and by phone or mail, the right to participate in care planning, and the right to voice a grievance without fear of retaliation. These rights also cover the specific protections around transfer and discharge that apply before a facility can require a resident to leave — see our discharge and eviction explainer for that process. The Ohio Long-Term Care Ombudsman program, covered in depth in our ombudsman and APS explainer, is the primary avenue for enforcing these rights when a family believes a facility has violated them, alongside filing a complaint directly with the Ohio Department of Health.
