Yes. Ohio Revised Code Section 3721.121 requires the administrator of a licensed facility to request a criminal records check through the Ohio Bureau of Criminal Identification and Investigation (BCII) for any applicant who is under final consideration for a position involving direct care to an older adult — this covers residential care facilities and adult day-care programs, not just nursing homes. The law allows a facility to employ an applicant conditionally while the background check is pending, but it must formally request the check within five business days of the person's start date. The requirement does not apply to unpaid volunteers, and a staffing-agency referral can sometimes rely on a check the agency already performed within the prior year. This is a statutory floor, not a ceiling — some Columbus-area communities go further with additional screening, so it's reasonable to ask a specific community about its hiring and screening practices directly during a tour.
